Terms of Service

1. Service Description
ozeye (“the Service”) provides an AI gateway that routes API requests to EU-hosted AI model providers. The Service includes an OpenAI-compatible API endpoint, a web-based chat interface, a model directory, preset management, usage analytics, and account management tools. The Service is operated by ozeye, a Dutch sole proprietorship (eenmanszaak) established in Arnhem, the Netherlands, operated by Mack Jupiter Maier (KVK 42115615).
2. Account and Access
You must create an account to use the ozeye API and chat interface. You are responsible for maintaining the confidentiality of your API keys and account credentials. You must not share API keys with unauthorized parties or transmit them over insecure channels. You are responsible for all activity that occurs under your account.
You must be at least 16 years old to create an account. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate.
3. Pricing and Payment
ozeye operates on a prepaid credit model. You add credits to your account, and usage is deducted per token processed. The optional hosted web search feature (see the docs) deducts a flat fee per search instead. Current prices are listed on the pricing page and model detail pages. Prices may change with 30 days’ notice.
Card, iDEAL, and Bancontact payments are processed by Mollie B.V. (Amsterdam, Netherlands). Monero top-ups use a one-time payment address generated by ozeye's self-hosted payment stack. Credits are non-refundable except where required by Dutch consumer law; Monero refunds are not supported. Unused credits expire 24 months after the last top-up.
4. Acceptable Use
You agree not to use the Service to:
- Violate applicable law (EU, Dutch, or your local jurisdiction)
- Generate content that is illegal, harmful, defamatory, or infringes third-party rights
- Generate CSAM or other content prohibited under the EU Digital Services Act or AI Act
- Attempt to circumvent rate limits, usage caps, or security measures
- Reverse-engineer, probe, scan, or stress-test the Service without written permission
- Resell access to the ozeye API without a written reseller agreement
- Send automated traffic designed to degrade the Service or other users’ experience
- Use the Service to train competing AI models without explicit permission
Violations may result in rate limiting, account suspension, or termination at our discretion. For serious violations (illegal content, abuse, fraud) we may report to the relevant authorities as required by law.
5. Data and Privacy
ozeye enforces zero data retention on AI request content. Prompts and completions are never stored. See our Privacy Policy and Subprocessors list for full details on data handling.
If you use the Service to process personal data on behalf of your own customers, GDPR Art. 28 requires a Data Processing Agreement between your company and ozeye. Request one via our DPA page.
6. Intellectual Property
You retain all rights to the content you submit to the Service (prompts) and the content you receive (completions). ozeye claims no ownership or license over your content. Content generated by AI models may not be copyrightable in all jurisdictions; you are responsible for understanding the legal status of AI-generated content in your use case.
ozeye’s own software, including the gateway code, webui, and branding, is subject to the licenses noted in our source repository. The Service itself is operated by ozeye (eenmanszaak) and may not be copied or rebranded without permission.
7. Service Availability
ozeye routes requests to third-party AI providers. We do not guarantee the availability or performance of any specific model or provider. We provide automatic failover between providers where possible. The Service is provided “as is” without warranty of any kind, express or implied, to the maximum extent permitted by law.
Enterprise customers may request a separate Service Level Agreement (SLA) with contractual uptime commitments.
8. Limitation of Liability
To the maximum extent permitted by Dutch law, ozeye is not liable for:
- Content generated by AI models, including accuracy, bias, or safety
- Interruptions in service caused by third-party providers
- Indirect, incidental, or consequential damages
- Loss of profits, data, or goodwill
- Any damages exceeding the amount you paid to ozeye in the 12 months preceding the incident
Nothing in these terms limits liability for gross negligence, intentional misconduct, or matters that cannot be excluded under Dutch mandatory law (including consumer protection law).
9. Termination
You may terminate your account at any time from the dashboard or by emailing us. On termination, we will delete your personal data in line with our Privacy Policy (usage metadata required for statutory purposes will be anonymized). Unused credits are non-refundable except where required by law.
We may suspend or terminate your account for material breach of these terms, after reasonable notice where possible.
10. Changes to Terms
We may update these terms with 30 days’ notice by email and in-product notification. Continued use of the Service after changes take effect constitutes acceptance of the updated terms. If you do not agree, you may terminate your account before the changes take effect and receive a refund of any unused credits.
11. Governing Law
These terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of Amsterdam, the Netherlands. Consumers may also bring claims in the courts of their place of residence under the EU consumer protection rules.
